Terms of Service

These Terms of Service (“Terms”) govern your use of the websites and software products provided by Desert's Edge Solutions LLC (“we,” “us,” or “our”), including the AdaptiveTest platform, EdTechScout, the Dark Agent Factory products, and Coppertier. By accessing or using our services, you agree to these Terms.

Desert's Edge Solutions LLC is a Texas limited liability company.

1. Service description

We build and operate software products. Among them, AdaptiveTest is an AI-powered adaptive testing platform for K-12 education that includes:

  • An adaptive assessment engine powered by Item Response Theory (IRT)
  • AI question generation that creates standards-aligned assessment questions using Anthropic's Claude
  • AI learning recommendations that generate personalized next steps for teachers
  • Integration with school systems via OneRoster (SIS), LTI 1.3 (LMS), and QTI 3.0 (question standards)

Each product's own site describes that product's features. Product-specific terms posted on a product's site apply in addition to these Terms.

2. Accounts and access

Where a product offers accounts, you are responsible for keeping your credentials secure and for all activity under your account. In AdaptiveTest, school administrators and teachers create and manage accounts, and student access is provisioned by authorized school personnel.

3. Acceptable use

You agree to use our services only for their intended purpose. You may not:

  • Attempt to access data belonging to other organizations or users
  • Attempt to reverse-engineer, exploit, or compromise the security of any product
  • Use AI-generated content in ways that misrepresent its origin
  • Use an education product for purposes unrelated to education

4. Intellectual property

Content you create with our products, such as questions generated for your classroom, belongs to you or your organization. Assessment data and student records belong to the school or district. Our product code, design, and underlying technology remain the property of Desert's Edge Solutions LLC.

5. AI-generated content

Several of our products use Anthropic's Claude. While we work to ensure quality and accuracy, AI-generated questions, recommendations, and analyses should be reviewed by a person before use. We do not guarantee that AI-generated content is free from errors.

6. Service availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability, and we make reasonable efforts to give advance notice of planned downtime.

7. Payment terms

Paid subscriptions are billed according to the pricing plan selected on the relevant product's site. Free tiers, trials, and pilot programs are available as described there. Cancellation takes effect at the end of the current billing period.

8. Limitation of liability

To the maximum extent permitted by law, Desert's Edge Solutions LLC shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

Either party may terminate the agreement at any time. Upon termination, we will provide data export options where the product supports them and, upon request, perform data deletion in accordance with our Privacy Policy.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.
